PESHAWAR (Pajhwok): Several Pakistani politicians and civil society members have moved the Supreme Court mass deportations of Afghan migrants.
The apex court was petitioned on Wednesday to declare the government’s decision as illegal, unconstitutional and in conflict with fundamental rights.
The, joint petition was filed on Wednesday on behalf of Farhatullah Babar, Senator Mushtaq Ahmed, Amina Masood Janjua, Mohsin Dawar, Mohammad Jibran Nasir, Syed Muaz Shah, Ghazala Parveen, Imaan Zainab Mazari, Ahmad Shabbar, Advocate Imran Shafiq, Luke Victor, Sijal Shafiq and Rohail Kasi.
On behalf of the petitioners, Advocate Umer Ijaz Gilani prayed the top court to restrain the government from detaining, and forcibly deporting the illegal refugees.
He also sought an end to harassing those having proof of registration cards, Afghan Citizen Cards and documents application issued by UNHCR.
The court was appealed to ask the federal government to permit UNHCR and partner organisations to register, process and decide all asylum-seeking applications.
The court was urged order the government to coordinate with all relevant federal and provincial law enforcement agencies to secure the fundamental rights of all people currently in Pakistan
The government’s policy had failed to provide any mechanism to distinguish between birthright citizens and illegal migrants, the petition claimed.
It contended the policy of deporting the refugees was against the principles incorporated in Article 2A of the Constitution.
