KABUL (Pajhwok): Guests at this week Tanazur discussion said that reasons that bring into play Qisas and Hodud should be eradicated and other Islamic orders alongside Hodud should be also enforced to make the system inclusively Islamic.

Some guests believed that each Islamic order had its own place and importance and should be implemented.

The discussion started on Saturday evening on 5:30pm Afghanistan time and continued for two hours.

Three guests talked about the issue and 1,315 people listened the programme live.

In the past one year some people have been flogged over the crime they committed but on December 1, a man who stubbed another person to death was executed in public under Qisas Law.

Other orders should be implemented as well.

Religious Scholar Mawlana Abdul Sabour Abasi said Sharia is not only the name of implementing Hodud Law but Sharia is a completed system and Allah wants Islamic governments to implement all Sharia laws but currently this is a misunderstanding that the implementation of Qisas was the entire Sharia.

He said: “Allah Almighty said in Surat Al-Maidah to cut off the hands of robber man and robber woman, this is a punishment for their actions and a lesson for others. This matter is explained in Sura Al Maidah and verses that revealed before this Sura discussed Zakat and Ushar and the issue of financial support for the people. Therefore before the implementation of punishment the issues related to Zakat and financial support to the people should be addressed to prevent someone from stealing. If the hunger of the people is not satisfied, then in my opinion it is not healthy to implement half of the Shariat and not to pay attention to the other half.”

“Haqullah — Rights of Allah — prevails in the implementation of Hudod, therefore, the jurists have said that the Hodud punishment can be cancelled over doubts, other things related to the Hodud should also be implemented, such as you have not enforced the zakat system, the economic system of Islam has not been implemented, interest is involved, there is poverty and a man has millions of rupees, but he does not pay zakat, so you should take zakat from that person and give it to the poor before the implementation of Hodud,” he added.

Referring to the implementation of Hodud in public place, Mawlavi Abbas said: “The presence of two people during execution can be qualified for the term public while the presence of a large crowed can also be qualified for the term public in Sharia.”

He also critisised the judicial system of government and said the currently judicial system belonged to a group and the judges have not passed through a proper procedure but they became judge on the bases of relationship and references.

He said how would people and the world would believe on such a system, adding that Sharia Court are formed on the bases of credential, qualification while Organizational Court is formed from the members of an organization.

“Officials don’t trust the system; It has been one year that there is no constitution, there is no press law, individuals will be better persons, there is no doubt about it, but the system working right now is of their own will and wish,” he said.

Preciousness urged

Religious Scholar and Writer Mufti Basharat said Hodud and Qisas implementation is the order of Allah and nobody has any contradiction in this regard, all Muslims are agreed on this point.

He said: “A system does not become Islamic by Qisas and Hudod, but Islam is a perfect religion for all matters of life and the authorities of the Islamic system are obliged to implement all the rules of the religion, not only Qisas and Hodud. It should be noted that every order of religion is important in its place and should be enforced.”

He added that the Sharia limit has not yet been issued on theft; it does not mean that the Islamic Emirate will implement Qisas and ignore punishment to thief, investigation and diligence to implement these orders is also a Sharia order. Hodud has been implemented once in the past 18 months, so it seems that the system is very strict in this regard.

Forgiveness is better than execution, the judge and ruler will advise the heir of the deceased to forgive, but when the decision to the ruler he does not have the right to amend it, he said.

.The Islamic Emirate is working to prevent interest and establish zakat and the Islamic economic system, and this does not mean that if there is no economic system, the limits will be suspended because the judge is obliged and cannot offer relaxation in the Sharia law, according to Mufti Basharat.

Referring to the execution of limits in public, he said: “The more people there are, the more lessons will be learned, but I agree that such incidents should not be made public and the Islamic Emirate does not allow them.”

He said the appointment of judges in the Islamic system has been done through examination and a proper system and there is no illegal appointment, if anybody existed he should be brought in the government notice.

Hodud should be implemented on all equally

Legal affairs expert Abdul Shakour Dadras termed public awareness vital before the implementation of Qisas. “I request that the people should understand so that doubts do not arise in the issuing of Qisas and with this the society will also be reformed.”

He said there was injustice, poverty and idleness in the society people are ignorant, that’s why if causes don’t go away the situation cannot improve, spreading fear is not essential, when the reasons behind the crimes are eliminated the crimes will reduce itself.

He added Hodud doesn’t recognize elite or middle class, rich or poor, but it is implemented equally on all and if there is imbalance in the implementation of Tazeerat then it could cause mistrust in the society.

“Why don’t we have an internal consultation program? These programs should be started with every class of society, such as scholars, economists, teachers, etc to improve of lives and protection our territorial integrity,” he said.

He called on government to be patient, hear all criticism and respond to every objection to resolve the problems through talks.

He stressed there was need for crucial engagement as well because living without international community was not possible.
